PROTECTION OF PERSONAL INFORMATION ACT, No. 4 of 2013 (“POPIA”)

 PRIVACY STATEMENT

This Privacy Statement applies to all data subjects of whom MPC processes personal information.

These data subjects are –

the employees and agents/representatives of MPC;

Customers, including their agents and representatives, to which MPC sells and markets its products and services; and

Service providers, including their agents and representatives, from which MPC procures products and services to produce its products and services.

The Information Officer is the responsible party to provide procedures that the conditions and all the measures set out in the POPIA that give effect to such conditions, are complied with at the time of the determining the purpose and means of the processing.

Compliance is achieved through the execution of this statement and internal procedures.

2. Data collection

2.1 Purpose

In the course of the business activities of MPC, it is necessary that certain personal information be processed by MPC to conduct its business activities.

2.2 Type of data

Only personal information that is necessary for the business activities of MPC are processed by MPC.

This includes the following –

Employees

Personal information required to establish a working relationship with employees and information required by statutory prescription.

Customers

Personal information required to interact in the business dealings between the parties.

Suppliers

Personal information required to interact in the business dealings between the parties.

2.3 Source of data

Original data

Only personal information provided directly to MPC is processed and it is considered that through the voluntary provision of the personal information to MPC, such data subjects have consented to the processing thereof.

The personal information provided by the data subject will be recorded as provided by the data subject.

Third party source

In the event that it is necessary to obtain personal information from a third party, MPC will obtain the prior consent form the data subject.

2.4 Updating of data

The data subject has the duty to inform the Information Officer of MPC of changes in personal information, after which it will be updated accordingly.

The data subject may at any time request the Information Officer to access the personal information held by MPC and to request the updating thereof with the amended information provided to MPC.

 3. Data usage

The personal information gathered by MPC directly from a data subject is necessary for the effective administration of the business activities between itself and the data subject and, where applicable, to comply with statutory prescription.

MPC may use the personal information to communicate/ promote its business and related activities directly to a data subject.

The personal information will not be divulged to other parties, unless required so by statute or with the prior consent by the data subject.

4. Data storage

Data is stored in hard copy and in electronic format on computer and removable electronic storage devices (e.g., external hard drive).

This is stored on site at the business premises of MPC, as well as by third party hosting.

5. Data Quality

The personal information provided by the data subject will be recorded as provided by the data subject.

The data subject has the duty to inform the Information Officer of MPC of changes therein.

The data subject may at any time request the Information Officer to access the personal information held by MPC and to request the updating thereof with the amended information provided to MPC.

6. Data security

MPC will take all reasonable measures to protect Personal Information in its possession. This includes staff training, confidentiality agreements with staff, separation of duties and restricted access to information. These measures are overseen by the Information Officer.

Should MPC become aware of a data breach whereby any personal information has been accessed or acquired by any unauthorised person, MPC will inform the data subject thereof as soon as possible as provided for in POPIA.

7. Data retention

The personal information will be retained for as long as there is a business or employment relationship between the data subject and MPC.

Due to the at times non-regular transacting between MPC and its customers and suppliers, time may elapse between transactions. MPC assumes that a business relationship is in existence until the data subject informs MPC of the termination of the relationship. The personal information on record will therefore be kept on record until such notification by the data subject, after which it will be destroyed.

The data subject may at any time request the Information Officer to access the personal information held by MPC and request the destruction thereof.

Certain legislation prescribes the retention of the business documentation of MPC. In the event that personal information is contained in such documentation, the personal information will be retained by default until the retention period has expired.

Updates to this Privacy Statement

This Privacy Statement is date June 2021. MPC may update this Privacy Statement from time to time. The current Privacy Statement will be available on our website or available on request from our office.
